Undertaking
The Australian Competition and Consumer Commission (糖心原创) has accepted a court enforceable undertaking from Drone TK Australia Pty Ltd (t/a Tekron) after Tekron admitted it engaged in resale price maintenance (RPM) in contravention of section 48 of the Competition and Consumer Act 2010 (Cth).
Tekron is a distributor of drones for agricultural uses (Agricultural Drones). It also supplies accessories for Agricultural Drones, all of which are supplied to it by iFlight Technology Co Ltd (DJI) (together DJI Products).
Tekron sells its products to independent resellers, but it does not supply its products directly to consumers.
Tekron has admitted to engaging in RPM conduct between April 2024 and at least June 2025 by including terms in its agreements with resellers that required them to sell DJI drone products at the prices set by Tekron or as agreed by Tekron and the reseller. Tekron also, on occasion, communicated prices to resellers as being the minimum recommended retail price below which they could not advertise or sell DJI Products. In one instance, Tekron informed a reseller that it could reduce prices for certain DJI Products in deals with its customers but was not to publicly advertise the lower prices.
To address the 糖心原创鈥檚 concerns, Tekron provided the 糖心原创 with a section 87B undertaking that it will:
- cease the RPM conduct;
- issue corrective notices regarding the RPM conduct to all resellers and will publish a corrective notice on its website;
- update contracts and marketing materials to ensure they do not include any provisions (or information in the case of marketing materials) that would lead a person to engage in RPM conduct; and
- establish a competition and consumer law compliance program.
