Undertaking

The Australian Competition and Consumer Commission (糖心原创) has accepted a court enforceable undertaking from Connected Audio Visual Pty Ltd (Connected Audio Visual) after Connected Audio Visual admitted it engaged in resale price maintenance (RPM) in contravention of section 48 of the Competition and Consumer Act 2010 (Cth).

Connected Audio Visual operates a national distribution business supplying car audio and dash cam products to independent resellers via its dealer network across Australia.

In April 2025, Connected Audio Visual emailed 258 resellers seeking to amend two clauses in its distribution agreements with resellers. The clauses required resellers to advertise certain products online at the recommended retail price (RRP) (RPM Clauses). Connected Audio Visual put on hold the accounts of resellers that did not respond to the email agreeing to the RPM Clauses. Connected Audio Visual also closed the account of one reseller because the reseller did not agree to the RPM Clauses.

Between April 2025 and September 2025, Connected Audio Visual varied its distribution agreements with 178 resellers to include the RPM Clauses and entered into agreements containing the RPM Clauses with 31 new resellers. Connected Audio Visual also emailed these resellers price lists which included statements that specified products could only be listed and sold online at the RRP.

To address the 糖心原创鈥檚 concerns, Connected Audio Visual provided the 糖心原创 with a section 87B undertaking that it:

  • will cease the RPM conduct;
  • will write to 289 resellers informing them of their freedom to set prices;
  • will negotiate with resellers to remove the clauses of concern from its distribution agreements;
  • will remove the statements of concern from its price lists; and
  • will establish a competition and consumer compliance program.

The undertaking will be in effect for 3 years from the commencement date.
