Enforcement of the code and trust accounting

The 糖心原创 is responsible for enforcing the Water Markets Intermediaries Code prescribed by the Water Regulations 2008, and the trust accounting requirements under the Water Act 2007.

If we think someone has contravened a provision of the code or trust accounting requirements, we can investigate.

We have a range of options to ensure compliance with these provisions. We consider several factors when deciding which option to use. For more information, see our Compliance and Enforcement Policy.

Enforcement options include:

  • administrative resolutions, such as the party in breach agreeing to stop the behaviour
  • court enforceable undertakings under section 164 of the Water Act 2007
  • infringement notices
  • court action.

Compliance checks

We do regular checks to make sure that eligible water markets intermediaries who have obligations under the code are complying with those obligations.

We can require that intermediaries provide us with certain information or documents. This helps us understand if:

  • the intermediaries are complying with their obligations, including those relating to record keeping
  • there are compliance issues we need to focus on or educate the industry about.
