ÌÇÐÄÔ­´´

A mandatory code on bulk wheat terminal access commenced on 30 September 2014, replacing the previous access undertakings regime administered by the ÌÇÐÄÔ­´´. The Wheat Port Code of Conduct regulates bulk wheat port terminal operators to ensure that exporters have fair and transparent access to terminal facilities.

In January 2014, ARTC submitted a proposed variation to the accepted Hunter Valley access undertaking to the ÌÇÐÄÔ­´´ for assessment.

The ÌÇÐÄÔ­´´ has granted an exemption for GrainCorp’s Carrington terminal at the Port of Newcastle under the new mandatory code on bulk wheat terminal access.

On 28 September 2011 the ÌÇÐÄÔ­´´ accepted the 2011 Undertaking provided to the ÌÇÐÄÔ­´´ by CBH on 20 September 2011.

GrainCorp provided the ÌÇÐÄÔ­´´ with a revised Proposed 2011 Undertaking on 31 January 2011 which contains technical amendments to the Undertaking lodged on 22 September 2010.

Co-operative Bulk Handling (CBH) is a bulk handling company that operates four bulk wheat port facilities in Western Australia.

On 28 June 2013 ARTC submitted a request to vary its 2011 undertaking to the ÌÇÐÄÔ­´´.

ARTC is required to review the accepted access undertaking five years after the commencement date to determine whether any amendments to the undertaking are required as a result of changes to industry circumstances or Government legislation, rules, or regulations.

The Hunter Valley Access Undertaking (HVAU) accepted by the ÌÇÐÄÔ­´´ on 29 June 2011 requires ARTC to submit documentation for the purposes of an annual compliance assessment conducted by the ÌÇÐÄÔ­´´.
